DUI Drugs

In California, a person can be arrested for driving under the influence of drugs or alcohol or a combination of drugs and alcohol. California Vehicle Code, Section 23152(a) makes it unlawful to drive while under the influence of drugs, alcohol or a combination of drugs and alcohol. Drugs can be both legal prescription drugs like Norco, Valium, Oycontin, Xanax, Vicodin or illegal drugs like marijuana, cocaine, and methamphetamine.

A person is under the influence of an alcoholic beverage under the influence of a drug or under the combined influence of an alcoholic beverage and a drug when as a result of drinking such alcoholic beverage and using a drug his/her physical or mental abilities are impaired to such a degree that he/she no longer has the ability to drive a vehicle with the caution characteristic of a sober person of ordinary prudence under the same or similar circumstances.

If a police officer contacts you and believes that you are exhibiting signs or symptoms that you may be under the influence of a narcotic you may be arrested for DUI drugs. Common symptoms include rapid speech, sweating, unusual or twitching movements, or dilated pupils. The investigation on a DUI drug case is the same as for alcohol. If the officer suspects drugs, you will be asked a series of pre-investigation questions regarding what medications or drugs you have taken. If you admit that you are on medications or drugs, you will be asked to perform FST's. If you fail the FST's you will likely be arrested and asked to provide a blood test.

A person arrested for driving under the influence of drugs may be in more trouble than an alcohol related drunk driving arrest because the person can also be charged with Health and Safety Code Section 11550 being under the influence of drugs. Depending on the facts of the case and the types of drugs involved the punishment for DUI for drugs will generally include many of the same punishments as an alcohol-related DUI. If the HS code section 11550 is charged and proved, punishment may be enhanced and include jail or a drug treatment program.
