Non Resident DUI Arrest

If you have an out of state license when you are arrested for DUI, the Officer should not take your license. Just like a CA resident, you will be given notice that your privilege to drive a motor vehicle in California will be suspended in 30 days unless you request a DMV hearing within 10 days to contest the suspension. When you set up the DMV hearing, you you will ask for a stay on the suspension which postpones the suspension pending the outcome of the hearing. You should consult with an attorney regarding defending you at the DMV hearing.

Interstate Compact

Most states belong to the "Drivers License Compact" an agreement where each member state agrees to share an individual's driving history with each other. If you suffer a CA DUI conviction, it's supposed to appear on each member states DMV records because the CA DMV is supposed to notify the driver's home state of the action. Sometimes this happens and sometimes it doesn't. If your home state doesn't find out about it, consider yourself lucky. If you have an out-of-state license and your home state does find out about it, expect your issuing state to impose the DMV consequences it normally imposes for a comparable DUI conviction in your home state. Because of the potential consequences in your home state, it's just as important for non-residents to fight a CA DUI charge.

If you intend to return to CA, you need to take steps to make sure that upon your return to CA you will be legally allowed to drive in the state. You do this by filing a form with DMV that you are a resident of another state. When you return to CA, you can have your driving privileges fully reinstated either after three years or more have passed or if you have completed a DUI program.

Don't Ignore the CA DUI

Typically, a warrant will issue which can have significant consequences and may even lead to an arrest back at home or detention at the border.
